A Call to Action Demanding That Senator Thune And Other Members of Congress Honor Their Oath of Office & Defend the Constitution

When sworn in, each member of Congress takes this Oath.

I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.

We believe Senator John Thune and other members of Congress have failed to uphold that oath.

Specifically, they have:

Abandoned the Senate’s responsibility to review executive nominations and instead confirmed all 21 of Trump’s cabinet or cabinet-level picks, all chosen for loyalty over competence, leaving the American people in harm’s way because of dangerous incompetence in the Cabinet and at key federal agencies like the CDC, the NIH, the FDA, the EPA, NOAA, and the NSA and FEMA.

Failed to Defend Fundamental Rights Guaranteed by the First, Fourth, and Sixth Amendments

Failed to defend fundamental rights guaranteed by the First, Fourth, and Sixth Amendments—including free speech, the right to assemble, freedom of the press, and due process. They have remained silent as masked ICE agents wearing no insignia, without legal accountability, arrest and murder US citizens and send detainees in the dark of night to prisons around the world without due process and with blatant disregard for injunctions from the federal bench prohibiting their behavior.

Abdicated Their Responsibility to Defend the Constitution

Abdicated their responsibility to defend the Constitution when they remained silent on April 18, 2025 as President Trump reviewed plans to suspend the Constitution and declare martial law – exactly 250 years to the day that Paul Revere left Boston and rode through the night to Lexington to warn the colonialists that the British were coming intent on perpetuating tyranny

Rather than stand strong for freedom, due process and the rule of law, Senator Thune and others have made no objection as President Trump escalates the use of the Justice Department, the IRS, and FBI to target critics, journalists, and universities and, most alarmingly, in an unprecedented way ignores the Posse Comitatus Act and deploys active military forces targeting domestic communities.

Failed Their Constitutional Duty as Defined by Article 1, Section 8 to Provide for the General Welfare of the US and to Regulate Commerce

Failed their constitutional duty as defined by article 1, section 8 to provide for the general welfare of the US and to regulate commerce and instead has supported the erratic use of tariffs to threaten other nations thus causing direct harm to small businesses, farmers and ranchers. In addition, these elected officials used the power of their office to pass President Trump’s July 2025 tax bill that transferred billions of dollars to the most wealthy Americans while slashing Medicaid funding by $1 trillion over 10 years—threatening access to healthcare and the existence of small community hospitals across rural America.

Failed to Protect the Right to Vote as Defined by the 15th, 19th, and 26th Amendments

Senator Thune and other members of Congress have been complicit in efforts by the President, the FBI, and the Justice Department to deny millions the right to vote despite clear and repeated language in the Constitution that the Congress has the responsibility and authority to assure the right to vote.

Abandoned Their Constitutional Duty to Declare War as Defined in Article I, Section 8, Clause 11

Senator Thune and other members of Congress abandoned their duty to declare war after full discussion and instead have stood by as an increasingly authoritarian President blithely put the U.S. Military in harms way against Iran, thereby destabilizing the mid-East when there was no immediate threat to the United States.

Call to Action

In this defining moment in the history of the United States, it is now time for Senator Thune and every other member of Congress to honor their oath of office by reaffirming their commitment to the Constitution and to an independent legislative branch.

Therefore, we the undersigned citizens from South Dakota and from across this great land, demand that Senate Majority Leader John Thune and every other member of Congress stand firmly against the unconstitutional use of executive power by joining those who over the last 250 years have committed themselves to a government of the people and to the formation of a more perfect union.

Please let our Members of Congress know I have signed this document and that I support We the People STAND UP’s committment to deliver regular updates to Congress and to the press about the number of Americans who have signed the Call to Action. I also support the commitment, as we approach November, to be clear about those members of Congress who have honored their oath and those who have not.
